OtakuForge operates an online platform where Anime fans can create and sell a wide range of custom products inspired by their favorite series. From unique apparel and accessories to collectibles and home decor, we empower the Otaku community to express their passion through personalized designs. We are committed to protecting intellectual property rights and strictly prohibit users from creating or selling items that infringe on third-party copyrights, trademarks, or related rights. If you believe that content on our platform violates your intellectual property rights, please follow the steps outlined below to report it.
A. Reporting Intellectual Property Infringement
OtakuForge’s policy is to:
- Remove or disable access to content (e.g., text, graphics, photos) we believe in good faith infringes third-party intellectual property rights after receiving a valid notice.
- Terminate accounts of repeat infringers and remove their content.
If you believe content on OtakuForge infringes your copyright or other intellectual property rights, please send a notice to our Designated Agent with the following:
- Identification of the copyrighted work or intellectual property you claim has been infringed, including registration number(s) if applicable.
- Details of the allegedly infringing content, including:
- A description of how it infringes your rights.
- Its specific location on OtakuForge (e.g., URL or product link) with enough detail for us to locate it.
- Your contact information: full name, mailing address, phone number, and email address.
- A statement that you have a good faith belief the use is not authorized by the rights owner, their agent, or the law.
- A statement, under penalty of perjury, that your notice is accurate and you are the rights owner or authorized to act on their behalf.
- Your physical or electronic signature.
B. Action Upon Receiving a Valid Notice
Upon receiving a proper infringement notice, OtakuForge will:
- Remove or disable access to the allegedly infringing content.
- Notify the user whose content was removed or disabled.
- Terminate access for repeat offenders.
C. Submitting a Counter-Notice
If a user believes their removed or disabled content is not infringing or they have the right to use it (e.g., via permission or fair use), they may send a counter-notice to our Designated Agent with:
- Identification of the removed or disabled content and its prior location on OtakuForge.
- A statement, under penalty of perjury, that they believe the content was removed due to a mistake or misidentification.
- Their contact information: full name, mailing address, phone number, and email address.
- A statement consenting to the jurisdiction of the Federal Court in the district of their address (or the district where OtakuForge is located if outside the USA) and agreeing to accept service of process from the original complainant.
- Their physical or electronic signature.
If a counter-notice is received, OtakuForge may:
- Forward it to the original complainant.
- Restore the content or cease disabling it within 10-14 business days, unless the complainant files a court action against the user.
